Terms of Use Agreement

1) Who the Agreement Applies To

These Terms apply to all visitors, users, and others who access or use the Site (“you”). Your use of the Site constitutes your acceptance of these Terms.

2) License to Use Content and Download Models (Creative Commons BY-NC 4.0)

The Site offers free downloadable 3D models. Downloading and using those 3D models is governed by the applicable Creative Commons license shown for each model download. Unless otherwise stated for a specific asset, that license is Creative Commons Attribution–NonCommercial 4.0 International (CC BY-NC 4.0).

You must comply with the applicable Creative Commons license for any models you download and use from the Site, including restrictions on non-commercial use and any attribution and other requirements stated in the relevant license.

3) User Content and Comments

Commenting and Guest Mode

The Site includes a comments section. You may be able to comment as a guest without providing account information.

Optional Account (Email + Password) for Comment Editing/Reusing an Account

The Site may also allow you to create an account using an email address and a password to edit your comments and/or reuse your account in the future. If you choose to create an account, you agree to provide accurate information and to keep your credentials secure.

Your Responsibilities

If you post comments or other user content (“User Content”), you agree that:

• You are solely responsible for the User Content you submit.
• Your User Content must not violate these Terms or applicable laws.
• You will not impersonate others or misrepresent affiliation.
• You must ensure that your User Content does not infringe or violate any third-party rights.
• You must comply with the CC license terms applicable to any models or content you download and use.

4) Prohibited Conduct

You agree not to:

• Post offensive, abusive, hateful, or harassing content.
• Engage in harassment, threats, or intimidation of any person.
• Spam, advertise, solicit, or post repetitive or irrelevant content.
• Engage in illegal activity or facilitate wrongdoing.
• Infringe any intellectual property rights or other legal rights of others.
• Attempt to compromise, bypass, or interfere with the security, functionality, access controls, or protections of the Site (including attempting to extract data in ways not permitted).
• Circumvent any technical measures, rate limits, access restrictions, or other protections used to secure the Site or content.
• Attempt to access accounts, credentials, private information, or systems without authorization.

5) Moderation and Enforcement

The operator may, at its discretion:

• Remove, delete, or archive comments that violate these Terms, are offensive/abusive, appear to be spam, or otherwise pose compliance or safety concerns.
• Take enforcement actions to address breaches of these Terms, including removing User Content and restricting access.
• Preserve copies of content to the extent needed to comply with legal obligations, enforce these Terms, or investigate suspected violations.

You understand that moderation and enforcement are not guaranteed and that decisions are at the operator's discretion.

6) Account Security (If You Create an Account)

If you create an account, you are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.

The Site states that user passwords are encrypted and the operator does not view plaintext passwords. However, you acknowledge that the operator's responsibility for unauthorized access is limited. If unauthorized access results from your failure to keep your password secure, you are responsible for that risk.

If applicable, inactive user accounts may be deleted along with their complete account data after 1 year of inactivity.

7) Disclaimers

As Is Provision

ALL MODELS, CONTENT, AND MATERIALS ON THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE CONTENT WILL BE UNINTERRUPTED, ACCURATE, COMPLETE, OR ERROR-FREE.

8) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• IN NO EVENT WILL THE OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR ANY MODELS OR CONTENT OBTAINED THROUGH THE SITE.
• THE OPERATOR'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SITE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO THE OPERATOR FOR ACCESS TO THE SITE (IF ANY), OR (B) $100.

Some jurisdictions do not allow certain limitations, so some of the above limitations may not apply to you.

9) Intellectual Property

Site Content Ownership

The Site and its underlying materials (excluding the CC-licensed models, where applicable) are owned by the operator or its licensors and are protected by copyright and other intellectual property laws.

No Copying/Scraping Except as Allowed

You may not copy, scrape, or systematically extract content from the Site except:

• as expressly permitted by these Terms, or
• as allowed by applicable law, or
• for downloading and using models in accordance with the Creative Commons license terms applicable to those models.

10) Linking and Third-Party Sites

The Site may include links to third-party websites or referenced resources. You acknowledge that:

• The operator does not control third-party websites or their content.
• The operator is not responsible for third-party websites, their availability, or any content, products, or services they provide.

Affiliate links (if introduced in the future): The operator may use affiliate links in the future. If affiliate links are used, the affiliate partners may have their own terms and privacy practices that apply to you.

11) Term, Termination, and Access Changes

These Terms remain in effect while you use the Site.

The operator may suspend, terminate, or restrict your access (including blocking accounts or access to features) if you violate these Terms or if the operator reasonably believes such action is necessary for enforcement, safety, compliance, or to prevent harm.

You understand and agree that the operator has no obligation to maintain access to the Site, any specific feature, or any content.

12) Changes to These Terms

The operator may update these Terms from time to time. When the operator updates the Terms, the “Effective date” will be updated accordingly.

By continuing to use the Site after the updated Terms become effective, you agree to be bound by the updated Terms.

13) Children and Age Requirements

The Site is intended for general audiences. The operator does not knowingly collect data from children under 13 years of age. If you are under 13, do not use the Site or submit any information.

14) No Advertisements Currently

The Site currently does not display advertisements. The operator may change the Site's presentation or features in the future; however, any specific terms relating to advertising (if introduced) will be addressed through updated Terms where applicable.

15) Governing Law and Venue

These Terms are governed by the laws of the United States, without regard to conflict of law principles.

Venue and jurisdiction will lie in PENNSYLVANIA, USA unless otherwise required by law.
